Abstract

Tulisan ini membahas tentang pembaharuan hukum keluarga di Negara-nega ramuslim. Dari pembahasan ini diketahui bahwa metode pembaharuan dilakukan denganmetode intra-doctrinal dan extra-doktrinal reform, regulasidankodifikasi. Dari sini, terdapattigatipologi Negara muslimberdasarkanpembaharuanhukum Islam yang dilakukan, yaitu Negara muslim yang menggunakanhukum Islam sebagainamadalam (fiqh) tradisional; negaramuslim yang mengadopsihukum Barat; dannegaramuslim yang menerapkanhukum Islam denganmenggunakanmetodedanprosedurlayaknyahukum Barat. Adapunaspekpembaharuanhukumkeluarga di Negara-negaramuslimdiantaranyaadalahpembatasanusiaperkawinan, control terhadappoligami, dalamhalperceraiandarisuamidanistridenganprosedurpengadilan, dalambidangwaristerdapatwasiatwajibah.
