Abstract

Dalam melakukan penuntutan jaksa penuntut umum dapat melakukan tindakan prapenuntutan terhadap berkas perkara yang dinilai belum lengkap.Prapenuntutan ini dilakukan sebelum berkas perkara diajukan ke pengadilan. Prapenuntutan ini dimaksudkan agar berkas perkara dapat dilengkapi, sebab berkas perkara tersebut nantinya akan digunakan sebagai dasar bagi jaksa penuntut umum dalam mempersiapkan penuntutan di depan sidang pengadilan. Tindakan prapenuntutan sangat penting guna mencari kebenaran materiil yang menjadi dasar dalam proses penuntutan.Penelitian ini bertujuan untuk mengetahui penerapan pasal 110 ayat (1) KUHAP dalam perkara Nomor REG.Penyidik : PDS-02/PKRTO/02/2013 di Kejaksaan Negeri Purwokerto dan hambatan yang timbul dalam perkara tersebut.
