Abstract

Sahnya perkawinan bila suatu perkawinan telah memenuhi persyaratan dari sudut pandang hukum Islam dan apabila tidak terpenuhinya persyaratan tersebut berarti perkawinan tidak sah. Lain halnya dengan persyaratan menurut perundang-undangan (Pasal 6, 7, 9, dan 10 UU No. 1 Tahun 1974),jika tidak terpenuhinya ketentuan pasal-pasal tersebut tidak menyebabkan perkawinan tersebut batal, hanya dikategorikan sebagai “pelanggaran undang-undang”.
