Abstract

Tindak pidana korupsi merupakan suatu fenomena kejahatan yang menggerogoti dan menghambat pelaksanaan pembangunan, sehingga penanggulangan dan pemberantasannya harus benar-benar diprioritaskan. Tidak semua tindak pidana korupsi menghendaki pembalikan beban pembuktian akan tetapi yang terbatas pada 2 (dua) hal yaitu: pertama delik pemberian (Grafitifikasi atau pemberian yang berkaitan dengan suap atau Bribery). Adapun penerapan pembuktian terbalik ini menemui hambatan dalam penerapan sistem pembuktian terbaliknnya, antara lain adanya rahasia perbankan yang sulit ditembus, karena adanya privasi dan etika dalam perbankan; serta adanya pengalihan uang atau pencucian uang hasil tindak pidana.
