Penelitian ini bertujuan untuk memaparkan konflik yang terjadi di Afghanistan di bawah kepemimpinan Taliban dengan menjelaskan pelanggaran apa saja yang terjadi, lalu disertai dengan jawaban maqāṣid al-syarī’ah al-Syathibi dan Jasser Auda atas konflik tersebut sebagai bentuk mencari kemaslahatan. Penelitian ini merupakan penelitian kualitatif deskriptif dengan pendekatan hukum Islam dengan konsep maqāṣid al-syari’ah. Hasil penelitian ini menunjukan bahwa maqāṣid al-syarī’ah menginginkan manusia mencapai kemaslahatan di dunia dan di akhirat dengan menjaga lima aspek, yaitu agama, jiwa, keturunan, harta, dan akal, ditambah menuju maqāṣid al-syarī’ah dalam bentuk pengembangan dan hak-hak asasi. Apa yang terjadi di Afghanistan merupakan sebuah kehancuran yang memang tidak sejalan dengan maqāṣid al-syarī’ah karena konflik tersebut hanya mendatangkan kemudaratan. Sehingga masyarakat Afghanistan tidak mendapatkan kemaslahatan.
